ESTQ Inc. – Contractor Privacy Policy

Effective Date: July 3, 2026 Last Updated: July 3, 2026

ESTQ Inc., a Delaware corporation ("ESTQ", "we", "us", or "our"), respects your privacy and is committed to protecting the data of the service providers, businesses, and contractors who use our technology platform ("Contractors", "you", or "your").

This Contractor Privacy Policy ("Privacy Policy") explains how we collect, use, disclose, and safeguard your information when you register an account, access our website, or interact with our lead referral and data-sharing systems.

For purposes of this Privacy Policy, "Contractor Information" means any information collected from or about a Contractor that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked to a Contractor.

IMPORTANT NOTICE: BY CREATING AN ACCOUNT, ACCESSING THE PLATFORM, OR INTEGRATING YOUR WORKFLOWS WITH ESTQ, YOU AGREE TO THE COLLECTION AND USE OF INFORMATION IN ACCORDANCE WITH THIS PRIVACY POLICY. THIS POLICY IS DIRECTLY INCORPORATED INTO AND SUBJECT TO THE ESTQ CONTRACTOR DATA SHARING AND LEAD REFERRAL TERMS AND CONDITIONS.

1. Information We Collect About Contractors

Unlike the anonymized project logs described in our Terms and Conditions, we must collect certain identifying parameters to run your user account, verify your business, and route target Leads.

1.1 Personal and Business Identifiers

  • Contact Details: Full name, corporate email address, primary phone number, and physical business/mailing address.
  • Account Credentials: Secure passwords, unique usernames, and automated access tokens.
  • Business Profile Data: Corporate names, dba ("doing business as") filings, operational trade categories, structural service area boundaries, operational capacities, and specific geographic ZIP codes served.
  • Professional Credentials: Trade license numbers, state business registrations, certifications, structural bonding confirmations, and insurance policy verification documents.

1.2 Device, Analytics, and Telemetry Data

When you navigate the ESTQ infrastructure, our cloud servers automatically log standard network telemetry:

  • Technical Identifiers: Internet Protocol (IP) address, browser fingerprints, operating system specifications, and access time configurations.
  • Usage Telemetry: Click sequences, response latency metrics, lead-acceptance speeds, time spent on internal platform dashboards, and page navigation loops.
  • Cookies and Tracking Tech: We employ persistent and session cookies, web beacons, and analytical software strings to maintain secure login states and evaluate interface usability.

2. How We Use Your Privacy Data

ESTQ utilizes Contractor profile data strictly for targeted corporate, marketplace, and platform management operations, including to:

  1. Provision and Secure Accounts: Verify your identities, establish your secure access panel, and audit account compliance.
  2. Optimize Lead Allocation: Match your declared trade skills and active service geography with inbound end-consumer requests.
  3. Facilitate Core Communications: Dispatched transactional notifications, text warnings regarding fresh Leads, platform updates, and mandatory administrative policy alters.
  4. Enforce Legal Protection: Confirm continuous trade licensing status, validate liability insurance coverages, minimize system exploitation, detect cybersecurity events, and execute the underlying Terms and Conditions.
  5. Refine Infrastructure: Analyze analytical patterns to remove user-experience chokepoints and streamline dashboard execution speeds.
  6. Artificial Intelligence and Automated Processing: ESTQ may utilize artificial intelligence, machine learning models, and automated systems to improve lead routing, estimate generation, fraud detection, platform analytics, quality assurance, and overall platform functionality. Such processing is intended solely to enhance the Platform and does not constitute automated legal, medical, financial, insurance, employment, licensing, or other legally binding decision-making.

3. How Contractor Privacy Data Is Disclosed

We do not sell, rent, or lease your identifying personal profile information to third-party data brokers. Contractor parameters are disclosed only under the following operational environments:

  • To Prospective Platform Leads (Customers): If you accept a target Lead through the marketplace, we may pass your public business attributes—including company name, phone contact, corporate website, trade numbers, reviews, and badges—directly to the customer to finalize the transaction.
  • To Authorized Sub-Processors and Vendors: We utilize verified third-party technical vendors (e.g., cloud hosting networks like AWS/GCP, automated notification triggers like Twilio, database managers, identity confirmation suites). These entities are bound by strict non-disclosure pacts and cannot use your attributes for external marketing. Contractor Information may be processed, transmitted, and stored by trusted third-party cloud infrastructure providers, payment processors, communication platforms, analytics providers, identity verification vendors, artificial intelligence service providers, and similar operational partners solely for purposes of operating and improving the Platform.
  • Corporate Restructuring: If ESTQ participates in a corporate merger, structural acquisition, asset liquidation, or a security buy-out, Contractor account archives may transfer as an active business asset to the surviving entity.
  • Mandatory Legal Disclosures: We will reveal account data if forced by an explicit subpoena, federal or state court mandate, law enforcement inquiry, or to protect the safety, legal rights, and physical assets of ESTQ, our employees, or the public. ESTQ shall not be liable for unauthorized access, security incidents, or data breaches occurring within independent third-party systems that are outside ESTQ's reasonable control, including cloud providers, hosting providers, payment processors, AI providers, telecommunications providers, and other independent vendors.

4. Security Standards & Encryption

ESTQ utilizes commercially reasonable technical, administrative, and cloud network security configurations (including Secure Sockets Layer (SSL/TLS) data encryption protocols) to secure your profiles against unlawful infiltration, deletion, theft, or manipulation.

However, no data transfer pipeline over the public internet or structural cloud storage cluster is 100% impenetrable. We cannot guarantee absolute computational security, and any data transmission you execute occurs entirely at your own risk.

In the event of a security incident affecting Contractor Information, ESTQ may provide notification to affected users when required by applicable law.

Contractors are responsible for maintaining the confidentiality of their account credentials and for all activities occurring under their accounts unless resulting from ESTQ's gross negligence or willful misconduct.

ESTQ shall not be responsible for delays, interruptions, or failures in protecting or processing Contractor Information caused by events beyond its reasonable control, including cyberattacks, internet outages, acts of God, governmental actions, power failures, or failures of third-party infrastructure providers.

5. Data Retention Boundaries

We preserve Contractor personal profile metrics for as long as your account registration remains active on our platform, or as necessary to fulfill the operational processes outlined in Section 2.

ESTQ retains Contractor Information only for as long as reasonably necessary to fulfill business operations, contractual obligations, legal compliance, fraud prevention, dispute resolution, accounting, tax, audit, and recordkeeping requirements. Certain information may be retained for longer periods where required or permitted by applicable law.

Closing a Contractor account does not require ESTQ to delete historical transaction records, licensing verification records, fraud prevention logs, accounting records, correspondence, or other information that ESTQ is legally permitted or required to retain. Such retained information may continue to be used for fraud prevention, audit, legal defense, dispute resolution, historical reporting, analytics, and regulatory compliance.

The termination of a Contractor's relationship with ESTQ shall not affect ESTQ's rights to retain and use information as otherwise permitted under this Privacy Policy.

6. Jurisdictional Privacy Rights (CA / DE / US)

Depending on your corporate jurisdiction or state of operation, you may possess specific data sovereignty liberties under state statutes (such as the California Consumer Privacy Act / CCPA, as amended by the California Privacy Rights Act (CPRA)):

  • Right of Insight/Access: The right to request structural confirmation of what exact categories of identifying data ESTQ holds concerning your enterprise.
  • Right of Rectification: The right to request immediate adjustments to erroneous, outdated, or incomplete phone details, addresses, or licenses.
  • Right of Erasure (Deletion): The right to demand that we scrub your profile parameters from our live active databases.

Note: If you demand profile erasure, we may be structurally incapable of feeding you continued Leads or supporting your account access, and we reserve the right to retain residual logs to satisfy statutory fraud-prevention and audit laws.

To exercise any of these privileges, please dispatch a formal, validated request to our support email address: [email protected]

Depending on applicable law, Contractors may also have the right to object to certain processing activities, request data portability, or withdraw previously provided consent where consent is the legal basis for processing.

6A. No Sale of Personal Information

ESTQ does not sell or share Contractor Personal Information for cross-context behavioral advertising as those terms are defined under applicable privacy laws, including the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA).

7. Third-Party Architectural Links

Our interface may contain reference points or active web-links to standalone external services, payment gateways, or municipal permit portals. ESTQ exercises zero tracking or oversight regarding the privacy systems or terms of third-party domains. We advise checking the independent guidelines of any hyperlinked page you interact with.

Accessing third-party websites or services is performed entirely at Contractor's own discretion and risk. ESTQ assumes no responsibility for the privacy practices, content, availability, or security of third-party websites or services.

8. Aggregated and De-Identified Data

ESTQ may permanently retain, combine, aggregate, anonymize, analyze, benchmark, create statistical models from, commercially utilize, license, and distribute de-identified information derived from Contractor activity, provided such information cannot reasonably identify an individual Contractor or business.

9. Public Business Information

Contractor grants ESTQ a non-exclusive, worldwide, royalty-free license to display Contractor's publicly available business information, including company name, trade categories, service areas, customer ratings, publicly available license information, logos, and trademarks solely in connection with operating, maintaining, marketing, improving, demonstrating, advertising, and promoting the Platform and its related services. Contractor represents and warrants that it has all necessary rights to grant the foregoing license.

10. Revisions to This Privacy Policy

ESTQ reserves the absolute discretion to refresh, rewrite, or update this Contractor Privacy Policy at any time. When modifications are successfully committed, we will alter the "Last Updated" reference code at the top of this Privacy Policy. Continued use of the Platform following the effective date of the revised Privacy Policy constitutes acceptance of the updated Privacy Policy.

11. Governing Law

This Privacy Policy shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any dispute relating to this Privacy Policy shall be subject to the exclusive jurisdiction of the state or federal courts located in the State of Delaware.

12. International Data Processing

Contractor Information may be transferred to, processed, and stored within the United States regardless of the Contractor's country of residence. By using the Platform, Contractor consents to such transfers where permitted by applicable law.

13. Children's Privacy

The Platform is intended solely for businesses and individuals who are at least eighteen (18) years of age. ESTQ does not knowingly collect personal information from children under the age of 18.

14. Limitation of Liability

To the fullest extent permitted by applicable law, ESTQ shall not be liable for any indirect, incidental, consequential, exemplary, punitive, or special damages arising out of or relating to the collection, processing, storage, disclosure, or security of Contractor Information. This limitation applies regardless of the legal theory asserted, including contract, tort, negligence, strict liability, or otherwise.
