Estq Referral Program Terms & Conditions

1. Program Overview

Estq Referral Program allows individuals (“Referrers”) to earn a reward for referring new customers to Estq or participating contractors.

The program is intended solely as a marketing referral program and does not authorize Referrers to act as contractors, estimators, or licensed professionals.

2. Eligibility

To participate, you must:

  • Be at least 18 years old
  • Be a U.S. resident
  • Provide accurate personal and tax information (W-9 if required)

3. What Counts as a Referral

A valid referral occurs when:

  • A Referrer shares a unique referral link provided by Estq
  • A new customer clicks the link and submits a request or engages
  • The customer completes a qualifying transaction (e.g., HVAC installation) with a participating contractor
  • The transaction is verified and paid

Estq reserves the right to determine what qualifies as a valid referral.

4. Referral Reward

Referrers may earn a reward equal to:

  • 3% of the total contract value
  • OR a fixed amount disclosed at the time of referral

Conditions:

  • Reward is paid only after project completion and payment confirmation
  • No reward for cancelled, refunded, or disputed transactions
  • Estq may adjust reward structure at any time

5. Important Legal Position

Referrers acknowledge:

  • They are not employees, agents, or representatives of Estq
  • They are not licensed contractors (unless independently licensed)
  • They do not provide technical advice, estimates, or inspections
  • They are only sharing general information or a referral link

6. No Professional Advice

Any pricing or estimates provided via Estq are:

  • Informational only
  • Based on aggregated data

Referrers must not:

  • Present themselves as experts
  • Guarantee pricing or outcomes
  • Provide technical recommendations

7. FTC Disclosure Requirement

In compliance with Federal Trade Commission guidelines, Referrers must clearly disclose their financial interest when sharing links.

Example:

“I may earn a referral fee if you use this link”

Failure to disclose may result in termination and forfeiture of rewards.

8. Payment Terms

  • Payments are issued via Stripe, ACH, or PayPal
  • Minimum payout threshold: $100
  • Payments may take up to 30–60 days after project completion
  • Referrers are responsible for all taxes

Estq may issue IRS Form 1099 where applicable.

9. Prohibited Activities

You may NOT:

  • Misrepresent yourself as a contractor or Estq employee
  • Use spam, bots, or deceptive marketing
  • Refer yourself (self-referrals)
  • Offer rebates or share your commission with customers unless approved
  • Violate any local, state, or federal law

Violation may result in termination, forfeiture of rewards, or legal action.

10. Geographic & Licensing Disclaimer

Referral rewards are for marketing purposes only. Nothing in this program constitutes brokerage, contracting, or requires a contractor license. All services are performed by independently licensed contractors, where required by law.

11. Modification & Termination

Estq may modify reward structure, suspend or terminate accounts, or cancel the program at any time, at its sole discretion.

12. Limitation of Liability

Estq is not responsible for:

  • Contractor performance
  • Pricing differences
  • Project outcomes

All agreements are between customer and contractor.

13. Governing Law

These Terms are governed by the laws of the State of Delaware.
